General Terms and Conditions for Users
These General Terms and Conditions establish the basic terms and provisions applicable to rental companies and individuals related to the use of Weido services. In order to provide rental services through the Weido platform, you must agree to the terms set forth below.
1.
Definitions: Highlighted words and/or capital letters. If you see a capital letter or a highlighted term, it is a defined term whose definition is provided.
1.1
These service terms (hereinafter “Terms”) constitute a binding legal agreement between you and Weido, governing your right to use the website weido.lt or the Weido mobile application and other Weido offerings (collectively Weido Platform) in Europe. The terms “Weido”, “Platform”, “we”, or “our” refer to the operator of the Weido Platform, represented by the company UAB “Eido technologijos”, located at Kaišiadorių r. sav., Žiežmarių apylinkės sen., Liutonių k., Strėvos g. 41, company code 305706667.
1.2
The Weido Platform offers a digital platform where its users (“Users”) can post, offer, search, and order rental services. Users who post and offer rental services are “Lessors”, and Users who search, order, or use rental services are “Lessees”. On the Weido Platform, the same User can be both a Lessor and a Lessee, but in relation to a specific rental item, they are either a Lessee or a Lessor.
1.3
Lessors offer rental services (“Item Rental”) and related services such as item delivery, usage instructions, consultation, and other services related to item rental (“Services”).
1.4
To use these services and other features of the Weido Platform, you must register a Account (user profile). During registration, you must provide accurate personal information and complete the necessary Know Your Customer (KYC) steps, and select the Account type Lessee/Lessor or Universal. If the information changes, you must update it in your Account.
1.5
We operate as the operator of the Weido Platform ((disclosed intermediary (VAT Law Article 2, Part 3)) and provider. We do not own, control, store, offer, or manage the services available on the Platform. Weido is not a party to agreements directly concluded between Lessors and Lessees, nor does it rent or lease items on the Platform, nor does it guarantee the quality of those items.
1.6
We adhere to the terms of use and privacy policies of other service providers, which complement these terms, such as the privacy policy, which describes our collection and use of personal data, our payment terms, which govern all payment services provided to users by Weido payment entities and representatives (collectively referred to as “Weido Payment and Settlement Rules”, Know Your Customer (KYC) identity verification service, and others.
1.7
If you are a Lessor, you are responsible for understanding and complying with all laws, regulations, and agreements with third parties applicable to your rental services.
1.8
We are not responsible for the quality of items rented by Lessors to Lessees through the Weido Platform, nor whether those items match the descriptions provided, are fit for their intended purpose, or are safe to use.
1.9
If you rent items on the Weido Platform (as a Lessor), you are also directly responsible for fulfilling any obligations you may have under applicable laws and regulations and the terms specified in the rental agreement related to the rental of items you have listed on our Platform. This includes Lessees’ rights under applicable laws and compensation for any damage caused by your rented item or items through the Weido Platform to Lessees or any other person.
1.10
If you are a Lessee, you are fully responsible for the items and their maintenance during the rental period, which you rent through the Weido Platform, including compliance with the terms specified in the rental agreement and compensation to the Lessor for any damage caused to the item or its loss. You are also responsible for any damage you cause to other people or property while using the items.
1.11
Contracting Parties – this term is used for clarity when referring to Lessors and Lessees together.
1.12
Visitor – a person who has not registered on the Platform.
1.13
User(s) – this term is used for clarity and refers to all legal and natural persons registered on the Platform.
1.14
These Platform Usage Rules – define the terms and rules for Users using the Weido Platform and its functionalities, when a contract is concluded and the Platform Rules are agreed upon, using the Platform to rent and deliver or rent items.
1.15
Rental Price – this is a component of the transaction, belonging to the Lessor, and is determined by the number of days and the daily rate set by the Lessor when registering the item. The rental price may include a Delivery Fee if such a service is provided.
1.16
Delivery Fee – this is an additional fee for the Delivery and Pickup service provided by the Lessor at the location specified by the Lessee, i.e., the Transfer Location of the item.
1.17
Weido Commission Fee – a fee applied to each contracting party, which is mandatory to pay to Weido for using the Platform.
1.18
Items – items offered by Lessors to Platform Visitors and Users, listed in the Lessor’s Listings in the main item list.
1.19
Mutual Invoices – invoices automatically generated between two parties: the Lessee and the item Owner (Lessor), which only indicate the financial relationship between Lessors and Lessees, not between the contracting parties and Weido.
1.20
Commission Fee – this is the intermediary service fee, which is paid by both contracting parties to the Weido Platform for using the Platform, amounting to 10% of the Rental Amount (the amount may change based on applied privileges).
1.21
Deposit Amount – this is the amount independently set by the Lessor when registering the item, which is held until the end of the transaction + 24 hours. Upon completion of the transaction, the full amount is returned to the Lessee unless compensation is requested by the Lessor. The amount is not considered an expense or income.
1.22
Compensation – this is an amount that may, but does not have to, be requested by the Lessor if the terms specified in the rental agreement or these rules are violated, provided that a Deposit is recorded at the start of the transaction on the Weido Platform.
1.23
Deposit Fee – this is a 2% Deposit storage fee from the Deposit Amount, paid by the Lessor to the Weido Platform if a deposit is held for the rental period. In case of late cancellation by the Lessee, the amount is applied to the Lessee.
1.24
Transaction Amount – this is the total transaction amount, including the item rental price, commissions, and other fees, excluding the deposit amount.
1.25
Universal Account Type – during user verification, you must provide the necessary data for both Lessor and Lessee. This Account type enables the Account to function as both a Lessor and a Lessee on the Weido Platform.
2.
Contract Formation
2.1
Before using Weido services, you must Register and log in to your Weido User Account and provide all required information and documents in the registration form. You can register as an individual or a legal entity. If you wish to register as a company managing item rentals, you must additionally provide a company extract, authorization of the company’s representative (if the representative is not the company’s manager), and VAT codes (if you are a VAT payer). Upon successful completion of registration, we will provide you with a Weido-approved Account, which you can access using your email, Google, or Facebook accounts. By clicking the “Register” button at the bottom of the registration form, you declare, ensure, and agree that:
2.2
under applicable laws, you have the right to enter into an Agreement with us and provide or use rental services using the Weido Platform;
2.3
when registering as a company, you agree that Weido will verify your data and contact you using the contact details you provided, as well as other publicly available information;
2.4
you have carefully read, fully understood, and agree to comply with these General Terms, including the obligations set forth herein and in the Agreement;
2.5
when we notify you of updates to these Terms or the Privacy Policy, by clicking the “Agree” button, you express your consent. Without consent, you will not be able to use the application, and you must notify us of your disagreement with the updated Terms at pagalba@weido.lt, and we may delete your account.
2.6
all information you have provided to us is accurate, correct, and complete;
2.7
you will always update your personal information in your Weido User Account (if it changes);
2.8
you will not allow other persons to use your Weido User Account, nor will you transfer or assign it to any other person (if you are registered as an individual);
2.9
when registering as a self-employed individual or a Company, you will provide correct documents (business certificate, company extract, etc.) and update these documents in your Account if they change or expire;
2.10
you will not use Weido services for illegal or unlawful purposes and will not hinder the proper execution of Weido services;
2.11
you will always fully comply with all laws and regulations applicable in the country where you provide or use rental services, including but not limited to laws governing item rental services;
3.
Right to Use the Weido Application and Weido User Account.
3.1
Permission to use the Weido Application and User Account. If you comply with the Agreement terms, we grant you permission to use the Weido mobile application and Weido User Account. This permission does not grant the right to sublicense or otherwise transfer the rights arising under this Agreement to third parties. Notwithstanding the foregoing, if the parties separately agree in writing, item rental companies may transfer the right to use the Weido Application and User Account to third parties.
3.2
To use the Weido item rental platform, you must install the mobile application, register a User Account, and agree to these terms. Upon installing the Weido application, your email is linked to the corresponding Account and included in our database. You can always change your email through Your Account -> Personal Information -> Email.
3.3
When using the Weido Application and/or User Account, the following is prohibited:
3.3.1
Decompilation, reverse engineering, or any other methods aimed at extracting the source code, business logic, data structure, or any other related information of the Weido mobile application, User Account, or other Weido software is strictly prohibited. This includes, but is not limited to, modifying, analyzing, reverse engineering, bypassing encryption, or using any other means that may allow unauthorized access, changes, or manipulation of the software’s functionality, security, or operation principles;
3.3.2
Additionally, the use of automated tools, devices, or services designed to perform the aforementioned tasks, as well as the dissemination, distribution, or publication of any information obtained through unlawful means, is prohibited. Any attempt to circumvent, undermine, or interfere with these prohibitions, including any breach of security mechanisms, will be considered a serious violation and may result in legal consequences, including criminal liability under applicable laws;
3.3.3
Weido reserves the right to take all necessary legal actions to protect its intellectual property, user data, and software integrity. Users who violate these provisions may be held liable for damages and must compensate for all losses incurred;
3.3.4
any means or form of altering the Weido Application or User Account or using modified versions of the Weido mobile applications or User Account;
3.3.5
sending, uploading files containing viruses, corrupted files, or any other malicious programs that may harm or negatively affect the operation of the Weido Platform;
3.3.6
attempting to access the Weido Application, User Account, or other Weido services without permission.
3.4
Intellectual Property Rights. All copyrights and trademarks, including the source code, databases, logos, and visual design, are owned by “Weido” and are protected under copyright, trademark, and/or trade secret laws and international agreements. By using the Weido Platform or other Weido services, you do not acquire any ownership rights to the intellectual property.
3.5
Advertising Restrictions. When using the Weido Platform, the following is prohibited: engaging in unsolicited third-party advertising, including but not limited to verbal advertising, distributing flyers or business cards, sharing branded gifts or other attributes with third parties, except with prior written consent from Weido. Additionally, passive advertising of prohibited goods and/or services, as well as goods and/or services that do not conform to good morals and ethics, or may tarnish the Weido brand and/or harm its reputation, is prohibited. It is also prohibited to directly solicit Weido customers and Users for direct transactions, thereby avoiding or bypassing Platform rules and fees or otherwise harming Weido’s business.
3.6
User Identity Verification (KYC). To ensure security on the Weido Platform, when registering, you must complete the Know Your Customer (KYC) steps, and Weido may also request you to confirm your identity or the identity of any person authorized to act on your behalf, verify Activity Data, and contact you personally via the phone number you provided to ensure that the person using the Weido application is the same person whose information was provided in the registration application. You will not be able to provide rental services until you or the authorized person has completed the verification process. If discrepancies are identified during the verification process, your Weido Account may be temporarily suspended or terminated, depending on the circumstances.
3.7
Termination of Permission to Use the Weido Mobile Application and User Account. The permission to use the Weido mobile application and User Account granted under this document is automatically revoked upon termination of this Agreement or if you do not agree to its updates. Upon termination or breach of this Agreement, you must immediately cease using the Weido mobile application and User Account, and we reserve the right to block and/or delete your Account without prior notice.
3.8
Legal Entities and Self-Employed Individuals:
3.8.1
If you are registered on the Weido Platform as a legal entity or a self-employed individual, you agree that UAB “Eido technologijos” will automatically generate an invoice or VAT invoice on behalf of the service provider (“Lessor”) and service recipient (“Lessee”) for the transaction with a unique serial number generated by Weido, indicating additional information about the expenses incurred on the Platform. These invoices will disclose the data of both parties, such as: company code or business registration number, company name, address, name and surname, VAT code. The invoice for your rental services will be issued along with the invoice issued by UAB “Eido technologijos” for the Platform service to both Parties, to facilitate easier management of invoices and transactions for Platform users. If the nature of your business changes or you decide to cease operations, you must update your profile information.
4.
Item Upload and Management. The Weido Platform provides easy-to-use tools that help create, edit, and manage your item rental listings. When creating a listing, you must provide detailed and accurate information about the item being rented, its price, additional fees (e.g., delivery fees or other related fees that must be included in the rental price), and all rules or requirements applicable to your rental and Lessees. You may also, but are not required to, set an applicable deposit for your item, which will be charged at the start of the transaction, but this Deposit Amount will not be considered your income and can only be used to claim compensation if such compensation is not claimed, the deposit amount will be returned to the Lessee.
4.1
You are responsible for:
4.1.1
the accuracy and completeness of the listing information, including ensuring that the availability (calendar) and photos of the rented item are regularly updated. This means you must regularly check and update the listing to reflect all changes, both regarding item availability and item condition, any defects, limitations, or other requirements that may apply to the use of the item, and you also undertake to provide the necessary instructions that may be required for the safe use of the item;
4.1.2
Items advertised on the Weido Platform must be the same and match all significant aspects according to the provided photos or descriptions, be safe to use according to the item’s intended use and instructions, for which these items are normally used, or for any purpose that the Lessor may lawfully offer for rent;
4.1.3
Your items’ security is ensured by a bilateral agreement, but Weido has no legal liability or accountability for damage to or loss of the item, and you are directly responsible for obtaining appropriate insurance for your rental services and items. We recommend thoroughly reviewing the insurance terms, including coverage details and exclusions, to ensure you are adequately protected. If you do not have such insurance, we recommend setting an appropriate deposit amount through the Weido Platform, which can be used in case of breach of contractual obligations, loss of or damage to the item, and other circumstances listed in these rules and the rental agreement;
4.1.4
You undertake to deliver the rented items to the Lessee if you have selected this option when registering the item listing, and according to the agreement you have made with the Lessee during the transaction (Transaction Information -> Lessee has requested delivery);
4.1.5
Any rented item will only be handed over to the Lessee after the transaction has been confirmed by Weido’s verification process, i.e., the transaction is given the status “Confirmed.” You must only hand over the item to the person confirmed by Weido, not to third parties, on the day specified in the transaction information, at the agreed time.
4.2
You can only create one listing per rented item, but if you offer multiple units of the same item, you can create separate listings for each unit.
4.3
Item Pricing. When registering an item, you set the daily price as the base price visible to all in the general item list screen and additional prices for the corresponding day ratio, which will be displayed in your public listings and applied when placing orders. In the public listings, prices are shown increased by the Weido commission rate. If you are a VAT payer, when setting item prices, you must include the VAT portion in the item price, and later when the transaction is made, the VAT amount will be deducted from the order amount as a separate line.
4.4
An item can be removed at any time, except in cases where there are ongoing or confirmed transactions. Such transactions are completed in the standard manner, and only after the transactions are completed can the item be deleted. However, after deleting the item, no new transaction requests can be sent or received for the same item.
4.5
You are fully responsible for the content provided in your listings and guarantee that you have the right to transfer the item to other persons or that you are the owner of the item.
4.6
You are responsible and accept liability if any content you provide violates third-party intellectual property or privacy rights. The content must comply with our Content Policy. Among other things, it is prohibited to upload discriminatory, vulgar, offensive, deceptive, violent, and illegal content.
4.7
These rules supplement, but do not contradict, the rules listed in the rental agreement concluded between the contracting parties.
4.8
Weido reserves the right to remove your uploaded item, or require you to correct the listing content or block your profile if these rules are not followed.
5.
Search and Order on the Weido Platform
5.1
Search. You can search for rental items or services based on criteria such as: item category, item name, location, price, rental period. You can also use filters to narrow down search results. Search results are displayed based on their relevance to your search and other criteria. Relevance depends on factors such as price, availability, activity, novelty, interests, popularity, previous rentals, or saved listings, Lessor requirements (e.g., minimum or maximum rental period), and other factors.
5.2
Order Initiation. When you order an item, you agree to pay the full Transaction Amount, including the rental price, applicable fees such as the Weido service fee, deposit amount, and other additional fees, taxes, and all other elements specified at checkout (collectively referred to as “Transaction Amount,” “Total Amount,” or “Total”). By submitting a transaction order request, you will need to sign the rental agreement with a signature, which you will add when making the first order. Subsequently, the signature will be used automatically until your consent expires. Upon receiving the order confirmation, a direct rental agreement is created between you and the Lessor for the provision of item rental services (“Rental Transaction”). In addition to these terms, you will be bound by all Transaction Terms and responsible for their compliance, including the cancellation policy and other rules, standards, policies, or requirements specified in the item listing and checkout terms applicable to your Rental Order. It is your responsibility to read and understand these terms, standards, policies, and requirements before placing an order. Please note that some Lessors may apply a Deposit, which will be refunded upon successful completion of the Transaction.
5.3
Item Rental Transactions. Item Rental Transactions grant you a limited right to use and manage the rented item. The Lessor retains the right to request the return of the item during the reservation period if it is reasonably necessary, permitted by your agreement with the Lessor, or permitted by applicable Lithuanian laws. If you exceed the agreed return time, the Lessor has the right to request the return of the item, including the right to apply reasonable additional fees for late return or breach of other terms specified in the rental agreement.
5.4
Renting an Item You are responsible for ensuring that you meet the minimum age, qualifications, physical fitness, or other requirements necessary to safely use the rented item. You are also responsible for informing the Lessor of any medical or physical conditions, or other circumstances that may affect your ability to properly use the item.
5.5
Transaction Progress and Statuses:
5.5.1
Transaction “Pending.” When the Lessee makes an item reservation and sends an order request to the Lessor, along with the transaction request, the Rental Amount including the Deposit Amount, if specified in the Lessor’s listing, is authorized. The transaction can be canceled free of charge until the transaction is confirmed by the item owner or is automatically canceled free of charge if the transaction is not confirmed.
5.5.2
Transaction “Confirmed.” In the case of a Confirmed Transaction, a bilateral rental agreement is concluded between the contracting parties, which defines the standard rental terms, item transfer location, and date. Both parties undertake to comply with the terms listed in the rental agreement and the Weido Usage Rules. A Confirmed Transaction can be canceled by either party, but fees may apply, see below “7. Weido Cancellation Rules.”
5.5.3
Transaction “Ongoing.” This status marks the start date of the transaction, is granted on the rental start date from 0:00h and is valid until the item return date specified in the transaction information. Once this status is granted, the transaction cannot be canceled in the standard manner. In case of necessity or dispute, you must contact Weido Support for transaction cancellation.
5.5.4
Transaction “Unfinished.” This status is granted when the transaction end is not confirmed by the Lessor and is valid for 24 hours after the return date specified in the transaction information. After the 24-hour period, the transaction is automatically closed, and final settlements are made. The Deposit Amount is returned to the Lessee within 10 business days unless compensation is requested by the Lessor.
5.5.5
Transaction “Completed.” The transaction completion is automatically recorded when the “Unfinished” status expires or when the Lessor confirms the transaction completion. The transaction can only be completed on the transaction end date. Upon completing the transaction, final settlements are made, compensation is requested if rental terms are violated and/or damage is caused to the item. Upon completing the transaction, invoices are generated shortly thereafter.
6.
Lessee-Specific Terms
6.1
This section applies only to Lessees.
6.2
When you agree to rent an item from a Lessor, the Lessor grants you a limited right to use that item for the agreed period. This right is personal and cannot be transferred to other persons.
6.3
You are responsible for ensuring that:
6.3.1
You acquire the right to use any item you rent through the Weido Platform;
6.3.2
You comply with all applicable laws, terms, and conditions listed in the rental agreement when using the item;
6.3.3
You comply with any reasonable instructions and guidelines provided by the Lessor to ensure the safe use of the item;
6.3.4
You return the item in the same condition as you received it (including normal wear and tear);
6.3.5
You can agree with the Lessor on the terms of item return, but you must ensure that the items are returned to the Lessor by the end of your rental period;
6.3.6
You will be responsible for any loss or damage you incur due to item damage, improper use, lack of skills or experience, theft, or negligence. The Weido Platform will decide whether you are responsible for such cases. When deciding on compensation claims, if no deposit was charged at the start of the transaction, Weido agrees to provide all necessary transaction information, including information about the persons involved in the transaction to law enforcement agencies, but Weido does not undertake to participate in resolving such disputes;
6.3.7
You can cancel an item order free of charge at any time until the transaction is confirmed by the Lessor. If the transaction is confirmed, additional fees will apply in case of cancellation. See Weido Cancellation Rules;
6.3.8
If you do not return the item within the agreed period, you must immediately inform the Lessor of your inability to meet the deadline. In such cases, the Lessor may request compensation for the delay in returning the item. If you wish to extend the rental period, send an additional reservation for the same item;
6.3.9
If you fail to meet the deadline and do not contact the Lessor, or if we (“Weido”) have reason to believe that you have damaged the item or the item has been stolen, you agree that the entire deposit or such portion of the deposit as the item is worth may be transferred to the Lessor. This deposit will be refunded, less any applicable fees and upon return of the item;
7.
Weido Payment and Settlement Rules During registration, when filling in payment information, you must provide your bank details if you are acting as a Lessor, or your payment card information if you are acting as a Lessee. If you are acting as a Universal user, you must provide both payment and settlement methods. If you are registering as an item rental company, you may specify the bank account number of a natural or legal person to whom payments should be transferred, as well as related details. When using the Weido mobile application, payments received for rental services will be summed up and transferred once a month to your specified bank account. We are not responsible for incorrectly executed money transfers if you provide incorrect bank, payment card, and/or account details. Weido reserves the right to share any information required under Council Directive (EU) 2021/514 of March 22, 2021, amending Directive 2011/16/EU on administrative cooperation in the field of taxation, including (but not limited to) any remuneration paid or credited to the User for activities conducted through the Weido Platform. If you do not provide the information required under the aforementioned Directive, Weido reserves the right to: I) temporarily suspend your Account, II) prohibit new registrations on the Weido Platform, and III) withhold rental payments until you provide the required information. For more details on payments and their procedure, see the points below:
7.1
The Lessee undertakes to pay the amount specified in the rental agreement to the Lessor through the Weido Platform and agrees that the Lessee’s rental fees along with the Deposit (if any), and the Platform’s applicable commission fees are authorized and automatically reserved on their payment card upon submission of the rental request on the Weido Platform. If the request is rejected by the Lessor, the reserved amount is refunded to the Lessee’s payment card.
7.2
If the Lessor does not confirm the Rental Request on the Weido Platform within 24 hours, the rental fees along with the deposit are refunded to the Lessee’s payment card, and the transaction is considered canceled (no fees apply).
7.3
The Lessor must confirm the transaction completion within 24 hours of the transaction end date, otherwise the Deposit is automatically refunded to the Lessee’s payment card, unless the Lessor declares any damage. In case of damage declaration, the Deposit may be partially refunded (or not refunded at all).
7.4
If the period from the rental request submission date to the rental end date is no more than 5 days (in case of Transaction confirmation), the rental fees and Deposit Amount are reserved on the Lessee’s payment card for the entire rental period. The deduction occurs when the Lessor confirms the Transaction completion (if no damage is declared, the Deposit (storage) fee is not applicable in this case, and the Deposit Amount is refunded to the Lessee).
7.5
If the period from the rental request submission date to the rental end date is more than 5 days (in case of Transaction confirmation), the rental fees along with the Deposit Amount and other fees are transferred to Weido’s account. Upon the Lessor confirming the successful completion of the Transaction on the Weido Platform, the Deposit Amount is refunded to the Lessee within 5-10 days. An additional Deposit Storage Fee is paid by the Lessor in this case, which is 2% of the Deposit Amount, regardless of whether the Deposit was used.
7.6
When damage is declared and the full or partial Deposit Amount is used, the Deposit (Storage) Fee is deducted from the Lessor’s payment, which is 2% of the Deposit Amount.
7.7
In case of late cancellation (when the transaction is canceled after its confirmation and more than 5 days have passed since the reservation request submission date), the Deposit Fee is paid by the party that canceled the transaction.
7.8
In case of Lessee’s Late Cancellation, a 30% Cancellation Fee of the Transaction Amount is applied, which will be paid to the Lessor.
7.9
Transaction rental fees along with declared damage amounts (compensation), (if any) are paid to Lessors during monthly payments, less Weido Platform fees, and are transferred to the Lessor’s specified account.
7.10
When the Lessor declares damage, the requested amount is automatically deducted from the Deposit Amount, without additional confirmation from the Lessee. (The maximum damage claim amount cannot exceed the specified Deposit Amount).
7.11
Invoices are automatically generated upon transaction completion or when the transaction is automatically closed, and fees are deducted from the Lessee’s payment card.
7.12
In all transaction cases, a 10% Commission Fee of the transaction amount is applied to each contracting party, except in cases where a Weido discount on commission fees is applied. See (Your Account -> Privileges and Discounts).
7.13
An invoice for commission fees is automatically generated for each contracting party.
7.14
If the terms listed in the rental agreement are violated, e.g., the Lessee does not appear at the item transfer location, the Lessor may request a Late Cancellation, which will be charged to the Lessee’s account, and similar terms and conditions apply to the Lessor.
8.
State Taxes, Pricing
8.1
The Lessor is responsible for properly declaring rental income in accordance with the laws of the Republic of Lithuania. Income consists of the rental price, and expenses include the Platform’s applicable commissions and other fees.
8.2
As the item owner, you are responsible for assessing and fulfilling your tax obligations and liabilities under the laws of the country where the rental is conducted, reporting, collecting, transferring, and including in your price any applicable VAT or other indirect taxes related to the activities conducted on the Weido Platform, even if you have not obtained a self-employment certificate, and Weido reserves the right to report your income to the SFS. Track your income and expense balances in the Weido Application -> Your Account -> Accounting.
9.
Weido Cancellation Rules
9.1
For Lessors
9.1.1
Transaction cancellation is possible until the first rental day begins. Example: if the transaction date is from November 3rd to 10th, the transaction can be canceled until November 2nd at 23:59h.
9.1.2
No more than 5 days have passed since the Lessee’s rental request submission date, and at least 24 hours remain until the transaction start date. The transaction can be canceled free of charge.
9.1.3
More than 5 days have passed since the Lessee’s rental request submission date or less than 24 hours remain until the transaction start date: In case of cancellation, you will pay an administrative service fee of the total transaction amount, and a 2% deposit storage fee of the Deposit Amount excluding VAT (if such was taken) will also be applied.
9.1.4
If the Platform or rental agreement terms are violated, a late cancellation may be initiated by Weido administration on behalf of the item Owner (Lessor), in which case the resulting fees are covered by the item Owner.
9.2
For Lessees
9.2.1
When the rental transaction has not yet been confirmed by the item owner: The reservation can be canceled free of charge within 24 hours of the request submission.
9.2.2
If your transaction request has already been confirmed by the item owner: In case of reservation cancellation, you will pay 30% of the transaction amount, as well as commission fees.
9.2.3
When more than 5 days have passed since the Lessee’s rental request submission date: In case of cancellation, an additional 2% deposit storage fee of the Deposit Amount excluding VAT (if such was taken) will be applied.
9.2.4
If the Platform or rental agreement terms are violated, a late cancellation may be initiated by Weido administration on behalf of the Lessee, in which case the resulting fees are covered by the Lessee.
9.3
General Cancellation Rules
9.3.1
If the Lessor does not confirm the Rental Transaction request on the Weido Platform within 24 hours, the rental fee reservation is automatically canceled, the transaction is considered canceled, and the Reservation Amount is refunded to the Lessee (no fees apply to either party).
9.3.2
The Reservation may also be automatically canceled 24 hours before the transaction start date if the transaction has not been confirmed.
9.3.3
The Deposit Storage Fee is paid (2% of the Deposit Amount excluding VAT) by the party that canceled the transaction.
9.3.4
The Deposit Storage Fee is paid in cases where more than 5 days have passed from the rental request submission date to the cancellation date.
9.3.5
In certain cases, if disputes cannot be resolved or in other unforeseen circumstances, Weido administration may cancel the transaction free of charge or require one of the parties to cover the resulting fees if rental terms are violated, e.g., the Owner or Lessee does not appear at the item transfer location at the agreed time, the Item does not match the description or is damaged, etc.
10.
Deposit Deduction and Compensation Claim Procedure
10.1
The Deposit is reserved on the Weido Platform until the end of the transaction + 24 hours, as a security measure for the rental transaction.
10.2
The Lessee undertakes to pay the amount specified in the rental agreement to the Lessor through the Weido Platform and agrees that the Lessee’s rental fees along with the Deposit (if any) are authorized and automatically reserved on their payment card from the time the Lessee’s rental request is submitted on the Weido Platform. If the request is rejected by the Lessor, the reserved amount is refunded to the Lessee’s payment card.
10.3
If the period from the rental request submission date to the rental end date is no more than 5 days (in case of Transaction confirmation), the rental fees and Deposit Amount are reserved on the Lessee’s payment card for the entire rental period. The deduction occurs when the Lessor confirms the Transaction completion (if no damage is declared, the Deposit (storage) fee is not applicable in this case, and the Deposit Amount is refunded to the Lessee).
10.4
If the period from the rental request submission date to the rental end date is more than 5 days (in case of Transaction confirmation), the rental fees along with the Deposit Amount and other fees are transferred to Weido’s account. Upon the Lessor confirming the successful completion of the Transaction on the Weido Platform, the Deposit Amount is refunded to the Lessee within 5-10 days. An additional Deposit Storage Fee is paid by the Lessor in this case, which is 2% of the Deposit Amount, regardless of whether the Deposit was used.
10.5
The Lessor must confirm the transaction completion within 24 hours of the rental end date, otherwise the Deposit is automatically refunded to the Lessee’s payment card, unless the Lessor declares any damage. In case of damage declaration, the requested amount is deducted from the deposit amount and transferred to the Lessor, and the remaining deposit amount is refunded to the Lessee).
10.6
The compensation amount cannot exceed the Deposit Amount. If the actual damage exceeds the reserved Deposit Amount, such disputes are resolved independently between the contracting parties. Weido does not resolve or interfere in the resolution of such disputes, except in cases where law enforcement agencies are required.
10.7
When damage is declared, and the full or partial Deposit Amount is used, the Deposit Transfer Fee is deducted from the Lessor’s payment, which is 2% of the Deposit Amount.
10.8
In case of late cancellation, the Deposit Fee is paid by the party that canceled the transaction.
10.9
Transaction rental fees and calculated compensation amounts (if any) are paid to Lessors during monthly payments, less Weido Platform fees, and are transferred to the Lessor’s specified account.
10.10
The requested compensation amount is not considered the Lessor’s income or earnings.
10.11
If the Lessor declares damage (Rental Transaction -> Complete Transaction -> No, Declare Violation -> Fill in Violation Declaration), the requested amount is automatically deducted from the Deposit Amount, without additional confirmation from the Lessee. (The maximum damage claim amount cannot exceed the specified Deposit Amount). The compensation amount is paid along with other monthly payments for completed transactions through the Weido Platform. In all cases where damage is declared, regardless of whether compensation is confirmed or rejected, the Lessor pays the Weido administration’s deposit fee.
10.12
Invoices are generated automatically within a few minutes after the transaction completion is confirmed or the transaction is automatically closed, and fees are deducted from the Lessee’s payment card.
10.13
If there is abuse of the deposit amount and the compensation is not commensurate with the damage caused, in such cases, Weido administration may review the dispute separately and reject the Lessor’s compensation claim and/or apply other penalties.
10.14
If you are a Lessor (item owner), we may request proof of purchase, timestamped photos, and other information to verify the accuracy of the information about any damage caused to the item, or other evidence confirming your claim for compensation from the Lessee. If you claim that the Lessee damaged the item, we may request photos taken before handing over the item to the Lessee and after the rental to confirm your claim that the damage was caused by the Lessee during the rental period.
11.
Additional Terms When registering as a natural person, e.g., a self-employed individual, you must agree to additional terms that you must comply with to use Weido services. These terms may include requirements, for example, to provide a copy of a self-employment or business certificate. To ensure the fairness and security of our services, Weido may conduct a risk check or request additional documents if there are signs that services are provided unprofessionally and this affects the safety of rental items and/or users. Failure to comply with these terms may result in the termination of the Agreement and the revocation of the right to use Weido services. By agreeing to the Additional Terms, you express your consent to these rules:
11.1
You agree that UAB “Eido technologijos” will generate invoices or VAT invoices between two parties, the Lessee and the item Owner (Lessor), hereinafter referred to as mutual invoices, indicating additional information about the expenses incurred on the Platform and will provide it along with the invoice issued by UAB “Eido technologijos” for the Platform services to the respective parties. This is intended to facilitate the transaction process, and no additional actions should be required by the service-providing Lessors.
11.2
Lessor invoices are automatically generated upon transaction completion only in cases where Lessors have provided their Self-Employment/ or Business Certificate number, and the confirming document on the Platform, during user verification, or through personal Account settings, or the Lessor is registered as a Legal Entity (company). For users who have not provided self-employment data, mutual invoices are not generated.
11.3
In automatically generated Lessor – Lessee invoices, the Weido Platform does not undertake to form specific serial numbers on behalf of the Lessor, but undertakes to assign unique serial numbers to the Owner according to the Platform’s defined procedure, and to use the contracting parties’ details provided on the Platform.
11.4
The conclusion and signing of the rental agreement between the parties, the Weido Platform, aiming to facilitate and make rental transactions between the parties safer, will generate an automatic Weido rental agreement (see standard Weido rental agreement) for individual and voluntarily concluded transactions on the Platform and will provide this agreement for signing by each of the contracting parties’ representatives during the transaction conclusion. Without the Users’ consent to use their signature for signing rental agreements, it will not be possible to conclude the transaction on the Platform. By giving consent to the use of the digital signature, the Agreements become effective and are provided signed along with the necessary parties’ details on the Platform (see Transactions -> Rental Transaction -> Rental Agreement) to each of the parties after the Transaction request is confirmed by the Lessor (until the transaction is confirmed, the agreement is not filled with the contracting parties’ personal data). Weido is not responsible for Users providing incorrect information in the agreement or failure to fulfill the agreement’s obligations.
11.5
In cases where Lessors have not provided data on their self-employment, Weido will only provide its invoices for commissions and other Platform fees, as Weido is a disclosed intermediary, i.e., a taxable person who intermediates in the supply of goods or services in a transaction on behalf of another and issues invoices (VAT Law Article 2, Part 6), therefore, it must issue invoices only for intermediary services (VAT Law Article 16, Part 1).
12.
Dispute Resolution between Lessees and Lessors
12.1
We encourage users to resolve any disputes directly. If you are a Lessee and have damaged or lost a rented item, you must immediately compensate the Lessor for the full repair (if possible) or replacement value of the item.
12.2
If you are a Lessor, we may request proof of purchase, photos of item damage, or other evidence confirming your claim for compensation from the Lessee. If you claim that the Lessee damaged the item, we may also request photos taken before handing over the item to the Lessee to prove that the damage occurred due to the Lessee’s actions (and was not present at the start of the rental period).
12.3
If the Lessee and Owner cannot resolve the dispute directly, the Lessee may contact (Weido Transaction -> Damage Declaration -> Disagree) within 24 hours of the transaction end date, for dispute resolution (You may also contact for other rental term violation reasons via email pagalba@weido.lt specifying the reason, attaching evidence, and the Transaction ID).
12.4
If under these Terms of Use you owe Weido, you agree that the debt will be paid from your card, or, if you are a Lessor, your payment amount will be reduced by the corresponding debt amount. If you have not added a payment card and do not have payments, you must make a bank transfer according to the details specified in the invoice no later than within 48 hours, otherwise Weido reserves the right to contact bailiffs and other law enforcement agencies to recover the debt. By agreeing to these Terms, you grant us the right to do so and waive the right to dispute this operation with your bank.
13.
Reviews
13.1
To ensure high-quality and safe services for Weido users, you agree that Lessees may evaluate Lessors, and Lessors may evaluate Lessees and leave reviews about the quality of the services you provided or received. Your overall rating will be linked to your public Account, and all users will be able to see reviews left by other users about you.
13.2
Each time a transaction is successfully completed, Lessees and Lessors will have the opportunity to leave reviews about each other.
13.3
In case of transaction cancellation, it will not be possible to leave a review.
13.4
Your review must be accurate and must not contain any discriminatory, offensive, defamatory, or other language that violates these terms, applicable laws, or our content and review policy. Reviews are not verified by the Weido Platform and may be inaccurate or misleading. If you believe that a review is incorrect or unfounded, you must contact Weido Support. If it is determined that a review or comment was submitted unjustifiably, such review and comment will be deleted.
14.
Content Usage Rules and Policy
14.1
You confirm that any images, texts, or information you upload to the Weido Platform, including any reviews about other users or items (collectively “Your Content”), will comply with the Content Usage Rules and Policy.
14.2
On the Weido Platform, you may or may be able to submit reviews, texts, photos, website links, videos, and other content, information, and other materials (“Content”). By submitting Content in any form and by any means, you grant Weido a non-exclusive, international, perpetual right to use, copy, broadcast, reproduce, distribute, adapt, reformat, modify, publish, translate, license, sublicense, and otherwise provide access to Your Content (without infringing third-party copyrights) anywhere and in any form, and otherwise use this Content, to provide and/or advertise the Weido Platform, through any media or platforms known or unknown at this time, including the Internet and social networks. If the Content includes personal information, it will only be used if such use complies with applicable data protection laws, according to our Privacy Policy.
14.3
We do not claim ownership of your content, and ownership rights remain with you except in cases where Weido finances the creation of content or assists in its creation, Weido may become the owner of that content, in which case the relevant documents indicating such rights will be provided or disclosed. You are fully responsible for all submitted content and guarantee that you are either the owner of the content or have the right to grant Weido the rights described in these terms. You are responsible and accept liability if any content you provide violates intellectual property or privacy rights. The content must comply with our Content Prohibition Policy and rules, which prohibit, among other things, discriminatory, vulgar, harassing, misleading, violent, and illegal content.
14.4
You agree that Weido may use third-party services or automated tools to translate content into other languages, and that Your Content may be translated using such services or tools. Weido does not guarantee the accuracy or quality of translations, and users are responsible for verifying the accuracy of translations.
14.5
You must ensure that you have the right to grant us the rights specified in these terms regarding any third-party content you include in your content (if you cannot grant such rights, you must inform us of other authors’ copyrights in your uploaded content).
14.6
Our right to use Your Content in no way affects Your privacy rights. Please review our Privacy Policy, which provides information on how we use your personal information.
14.7
We reserve the right to monitor any user content and refuse, reject, or remove any content if we believe it violates any Content Usage Rules.
15.
Liability for Actions and Compliance with Rules
15.1
You are responsible for your actions and inactions, as well as for the actions and inactions of those persons you allow to participate in providing your item rental services.
15.2
You are responsible for setting prices and creating rules and requirements for your listing. All fees and other charges must be clearly stated in the listing, and you may not collect any additional fees outside the Platform, except in cases where compensation is paid for damage to the item, damage caused to third parties or their property.
15.3
You may not encourage Lessees to create third-party Accounts, write reviews, share your contact details, or perform other actions that violate Weido Platform rules.
15.4
When using the Weido item rental platform, you do not have the right to:
15.4.1
bypass, disable, or otherwise interfere with any security features related to the Weido Platform;
15.4.2
provide false information, impersonate another person, or allow another person to use the Weido Platform on your behalf or in your interests, unless that person is authorized by you;
15.4.3
use the Weido Platform if we have suspended or prohibited you from using the service;
15.4.4
encourage, promote, or engage in illegal activities that cause theft, loss, damage, or injury to any person or property;
15.4.5
advertise or offer goods or services, except for item listings that you as the item owner or rental company have uploaded to the Weido Platform and are available to users;
15.4.6
send unsolicited advertisements through the Weido Platform;
15.4.7
modify, interfere, intercept, disrupt, or hack into the Weido Platform;
15.4.8
abuse the Weido Platform by recording malicious software or viruses. Steal user login data, hack into profiles, or otherwise harm the Weido Platform or any user’s equipment;
15.4.9
collect data from the Weido Platform other than in accordance with these service terms and rules;
15.4.10
use user content in violation of the license terms specified by the owner;
15.4.11
threaten, demean, or interfere with another person’s privacy, cause inconvenience or concern, or cause harassment, discomfort, injury, offense, or anxiety to another person;
15.4.12
use any automated system, conduct cyber attacks including, but not limited to, “robots,” “spiders,” and other software systems, to access the Weido Platform in a manner that sends more requests than a human can reasonably perform in the same period;
15.4.13
enter into any agreement to buy, sell, lend, or rent items outside the Weido Platform with any other user you first met through the Weido Platform. This is considered “tax evasion,” and upon identifying such violations, we may permanently block your Account or impose a fine;
16.
Rental Platform Operation Status and Limitations The Weido Platform is provided as is, depending on availability. We do not guarantee that access to the Weido mobile application will be uninterrupted or error-free. We also cannot guarantee that the number of rental orders will directly depend on your activity on the Platform.
17.
Limitation of Liability
17.1
To the extent permitted by applicable laws, Weido is not liable for losses incurred due to the use of the services, including (but not limited to):
17.1.1
direct or indirect damage to property or financial losses;
17.1.2
loss of profit or business interruption;
17.1.3
loss of contracts, contacts, or reputation;
17.1.4
loss of data;
17.1.5
removal of data from the Account or listing, We are not responsible for (complete) removal of data stored in the Product, including confidential and personal data, or disconnection of personal Accounts. We do not assume any liability or obligations for lost data.
17.2
Liability for concluded rental agreements: Lessors and Lessees are fully responsible for concluded rental agreements and their execution. The Weido Platform acts only as an intermediary and is not liable for losses or damage arising from the actions or inactions of the contracting parties. We are also not responsible for the Lessee’s failure to return or damage to property – the Lessee must compensate for any losses incurred as a result.
18.
Violation Reporting If you believe that a User, listing, or content poses a direct threat to a person or property, you must immediately contact local authorities before contacting Weido. Additionally, if you believe that a member, listing, or content violates our standards, you should report your concerns to Weido. If you have reported the issue to local authorities, Weido may request a copy of that report. Except as required by law, we are not obligated to take any action in response to any report. Reporting on the Weido Platform is done in the following manner: User Account -> Options icon (top right corner) -> Report.
19.
Final Provisions
19.1
All components of the Weido software, including any software fragments, designs, logic, and data, are “Weido.” We own our Website and mobile application. We, Weido affiliates, and/or our license holders, have all intellectual property rights to the Website, including its system, layout, software, trademarks, and domain names. This is our collective intellectual property, protected under applicable Lithuanian laws.
19.2
These Terms are drafted and adopted in accordance with the laws of the Republic of Lithuania.
19.3
The laws of the Republic of Lithuania apply to the relationships arising under these Terms.
19.4
All disputes arising from the execution or validity of these Terms are resolved through negotiations. If the parties fail to reach an agreement through negotiations, disputes are resolved in accordance with the laws of the Republic of Lithuania at the location of the Weido operator.
19.5
Users are responsible for any actions taken using the Weido application or account and must comply with all usage terms.
19.6
Weido reserves the right to update, modify, or supplement these usage terms at any time, notifying users accordingly (via email, informational messages, etc.).
